APP PRIVACY POLICY

Introduction

Alchemie Solutions, Inc., a Delaware corporation ("Company" or "we"), respects your privacy and is committed to protecting it through our compliance with this policy.

WE WILL NOT, UNDER ANY CIRCUMSTANCES, SELL, RENT, LEASE, SHARE OR GIVE YOUR PERSONAL INFORMATION TO ANY THIRD PARTY FOR PURPOSES OF SPAMMING YOU, OR FOR ANY OTHER THIRD-PARTY ADVERTISING, MARKETING OR PROMOTION.

This policy describes:

  • The types of information we may collect or that you may provide when you download, install, register with, access, or use our mobile and web applications (each an "App" and, collectively, the "Apps"); and
  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect in the Apps.

This policy DOES NOT apply to information that:

  • We collect offline or on the Company websites, including websites you may access through the Apps.
  • You provide to or is collected by any third party (see below).

Our websites and these third parties have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Apps. By downloading, registering with, or using the Apps, you agree to this privacy policy. This policy may change from time to time (see "CHANGES TO OUR PRIVACY POLICY" below). Your continued use of the Apps after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Definitions

“Non-Personal Information” means any information about you but individually does not identify you, such as information about your connection to the APP, the equipment you use to access our APP and usage details including IP Address, browser version, system type, number of visits and the length of visits to the APP.  Non-Personal Information is information that we collect about a group or category of products, services, or users that is not personally identifiable or from which individual identities are removed.    

“Personal Information” means any information which alone, or in combination with other information, can be used to identify a living person.

Children Under the Age of 13

The Apps are not intended for children under 13 years of age, and we do not knowingly collect Personal Information from children under 13. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at privacy@alchem.ie so that we can remove such Personal Information from our databases.

Information About You and How We Collect It

We collect several types of information from and about users of our App including the following information:

Personal Information

  • Personal Information might include: (a) contact information (e.g., name, address, phone number, date of birth and email address); (b) credit card information (e.g. credit card number); (c) information regarding your preferences related to us or the APP; (d) information regarding how you became aware of the APP; (e) business statistics; and/or (f) other personal or business data you provide to us. Personal Information also includes information about your activities, such as log files, information about your activity within the APP, demographic information, gender, geographic area, and preferences, when any of this information is linked to Personal Information that identifies you.

Non-Personal Information

  • Non-Personal Information is about you but individually does not identify you, such as information about your internet connection, the equipment you use to access our APP and usage details including IP Address, browser version, system type, page hits, number of visits, and the length of visits to the APP.
  • Non-Personal Information is information that we collect about a group or category of products, services, or users that is not personally identifiable or from which individual identities are removed.   

Information You Provide to Us  

We collect this information:

  • Directly from you when you fill in forms at the time of registration to use the APP, purchase products or services on the APP, provide feedback on our products or services, request any offer or coupon made available on the APP, send questions, solicitations, inquires, critiques or comments to us, survey responses, or register for specific online programs, or other transactions or activities.
  • Information that you provide by filling in forms on our APP. This includes information provided at the time of registration such as first name, last name, and phone number, and when content is added within the APP. We may also ask you for information when you input a support request, so that we can help to resolve the issue.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Your search queries on the APP.
  • For paid accounts, we may retain first and last name and the last four digits of a credit or debit card used.

You may provide information to be published or displayed ("Posted") on public or private group areas of an App or websites you access through an App (collectively, "User Contributions"). Your User Contributions are Posted and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable.  Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions.  Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Automatic Information Collection    

As you navigate through and interact with the APP, we may use automatic data collection technologies to collect certain information about your equipment, APP activities, and patterns including:

  • Usage Details. When you access and use an App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App.
  • Device Information. We may collect information about your device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
  • Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
  • Location Information. The App does not collect real-time information about the location of your device.

If you do not want us to collect this information, do not download the App, or delete it from your device.

Information Collection Technologies

The technologies we use for automatic information collection may include:

  • Cookies. A cookie is a small file placed on your device. It may be possible to refuse to accept cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of our App.
  • Web Beacons. Pages of an App and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).

Third-Party Information Collection

When you use an App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include (but are not limited to):

  • Analytics companies.
  • Your device manufacturer.
  • Your mobile service provider.

These third parties may use tracking technologies to collect information about you when you use an App. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Using Your Information

Subject to applicable laws of any relevant jurisdiction(s), we are the sole owners of all information collected on the APP.  However, we are not in the business of sharing, selling or renting any information gathered from the APP.  We will not sell, share or rent the information gathered from the APP to others in ways that are different from what is disclosed in this policy.  We use information that we collect about you or that you provide to us, including any Personal Information, to:

  • Provide you with an App and its contents, and any other information, products or services that you request from us.
  • Fulfill any other purpose for which you provide it.
  • Give you notices about your account, including expiration and renewal notices.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • Notify you when App updates are available, and of changes to any products or services we offer or provide through it.
  • To allow you to participate in the interactive features of the APP.
  • To store data and backup that data.
  • To track client information and prospective client information for purposes of marketing and accounting.
  • To collect information about your experience with the APP and to notify us of any delays or interruptions in your experience.
  • To communicate with you to notify you of actions taken in the system, or when your attention is needed to view or complete an item.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

The usage information we collect helps us to improve our Apps and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our App according to your individual interests.
  • Speed up your searches.
  • Recognize you when you use an App.

We may also use your information to contact you about our own goods and services that may be of interest to you. If you do not want us to use your information in this way, please opt-out using the method provided in the communication or email us at privacy@alchem.ie.

We may also use for any purpose any content that you generate within an App and store and/or share on our cloud, as outlined in the App End User License Agreement (EULA).  The EULA can be found by following the link at the bottom of this page.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.

In addition, we may disclose Personal Information that we collect or you provide:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by the Company about our App users is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights arising from any contracts entered into between you and us, including the App EULA, and for billing and collection.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers or others.

In addition, if you have a paid or educational account, you agree that we may include your school or organization name and logo in a list of Company customers. Within thirty (30) days of receiving your written request, we will remove such information from the list and make no further reference to you as a customer of the Company.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

  • Tracking Technologies. You may set your device to refuse all or some cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly.
  • Promotion by the Company. If you do not want us to use your email address to promote our own products or services, you can opt-out by the method provided in the product or service communication or you can email us at privacy@alchem.ie stating your request.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Accounts Provided by Your School or District

If your user account was provided to you by your school, district, or organization, then your account may be managed by a school, district, or organization administrator who may have access to all of your account information. In addition, such administrator may be able to:

  • Change your password.
  • Suspend or terminate access to your account.
  • View statistics regarding the use of your account.
  • Access, delete, or copy any information stored as part of your account.

We are not responsible for the privacy or security practices of your school, district, or organization, which may differ from those set forth in this privacy policy.

Access to, Transfer, Deletion or Amending Personal Information

In accordance with applicable law, you may (a) request access to any Personal Information we hold about you; (b) request that it be updated, rectified, deleted or blocked; (c) request that we delete part or all of any Personal Information we hold about you; (d) request that we restrict our processing of your Personal Information; and (e) request that we provide you or a third party with a copy of certain Personal Information about you (that is referred to as the right of “data portability”).

You can review and change your Personal Information by logging into the App and visiting your account profile page. You may request access to, review, change, or request the deletion of your Personal Information and preferences at any time by contacting us at privacy@alchem.ie. We will then take all reasonable efforts to correct or remove your Personal Information from our active database. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change Personal Information if we believe the change would violate any law or legal requirement or cause the Personal Information to be incorrect.

If you delete your User Contributions from an App or related website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other App users.

The Company retains the right in its sole discretion to remove or delete, temporarily or permanently, for any or no reason, any and all information, including Personal Information and Non-Personal Information profile and registration information, User Contributions, and any other information collected from or provided or generated by you during and after installing an App.

Data Security

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Apps, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet and mobile or web platforms is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through our App. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Data Retention

We will retain your Personal Information for as long as your account is active or as needed to provide you services. If you close your account, we will retain your Personal Information for a period where it is necessary to continue operating our business effectively, to maintain a record of your transactions for reporting purposes until this purpose no longer exists, and to retain as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our APP that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users' Personal Information, we will post the new privacy policy on this page, with a notice that the privacy policy has been updated, and may notify you by the email address specified in your account.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
